These Terms of Service ("Terms") govern your use of the Gymunity mobile application, website, and related services (collectively, the "Services"). By downloading, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services. If you use the Services on behalf of a company or organization, you confirm that you have the authority to bind them to these Terms.

2. Health and Medical Disclaimer

Gymunity does not provide medical advice. The Services, including workout trackers, custom routines, BMI calculators, and body measurement logs, are designed for informational and educational purposes only. You participate in all fitness activities entirely at your own risk.

Always consult a qualified healthcare professional before starting any new diet, fitness program, or training regimen. Do not disregard professional medical advice or delay seeking it because of something you have read or accessed through Gymunity.

3. Assumption of Risk

You acknowledge that physical exercise and fitness activities involve inherent risks, including the potential for severe physical injury or death. By using Gymunity to plan, log, or execute your workouts, you accept full responsibility for all risks associated with your physical activities.

4. User Accounts and Privacy

To access certain features, such as the social network or routine planner, you must create an account. You are responsible for maintaining the confidentiality of your login credentials.

• Data Control: You maintain full authority over your data. You may delete your account and all associated fitness data permanently at any time via the application settings.

5. User-Generated Content

Our Services allow you to post workouts, custom routines, body measurements, photos, and comments (collectively, "User Content").

• Ownership: You retain complete ownership of all User Content you upload to Gymunity.
• License: By posting content, particularly in the social network feed, you grant Gymunity a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute your content strictly to operate, provide, and improve the Services.
• Prohibited Conduct: You agree not to post content that is abusive, harassing, defamatory, or violates the rights of others. Gymunity reserves the right to remove any content or ban users reported for inappropriate behavior to maintain a safe environment.

6. Intellectual Property

All source code, UI/UX designs, algorithms (including our Hot Score algorithm), features, text, graphics, and trademarks (excluding User Content) are the exclusive property of Gymunity and are protected by international copyright and intellectual property laws.

7. Limitation of Liability

The Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. Gymunity, its developers, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use or inability to use the Services, or from any physical injury sustained while using the application.

8. Indemnification

You agree to indemnify, defend, and hold harmless Gymunity and its developers from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

9. Modifications and Termination

We reserve the right to modify, suspend, or discontinue the Services at any time without prior notice. We may also suspend or terminate your account immediately if you violate any of these Terms. We reserve the right to update these Terms at any time; continued use of the app constitutes acceptance of the new Terms.
